County Council Request for Further Information?

    Planning was due to be back yesterday as approved or not approved. I had checked with the council weeks ago and nobody blocked my application.

    Architect told me about two weeks ago he got a letter asking for confirmation that the council wanted to make sure we were using the exisiting entrance to the field where the site is and not putting a new entrance (original plan was a new entrance beside the old one but I told architect to tell council we were dropping this to get the planning).

    He said he'd send a letter back and we should have the planning no bother on schedule as normal. Then I get his secretary yesterday and she says that the planning has to go back into the paper now and it'll take another 2 to three weeks to be approved!?

    I've checked the county council website and it says they requested further information on the 23th of July and haven't got it yet.

    I'm just wondering why has it to go back into the paper? Has anyone had any problems like this?

    I don't see why it has to go back into the newspaper. If you had already stated in the original planning that you were going to use the existing site entrance, and the further information is just requesting confirmation of this, it shouldn't have to go in the newspaper as you are not making an alteration to the proposed application

    This is the part confusing me. Had you indicated on the newspaper/site notice, drawings, ect that you were going to use the existing entrance?

    If in pre-planning meetings, you said you wanted to use a new entrance, but the planner said no, they may be afraid that you are going to go ahead and build a new entrance anyway once you have planning for the rest. So that may be why they requested the FI.

    My advice would be to go to the planning search on their website and find your application. Under documents, there should be a Managers Report or something similar. It should explain why they requested the FI and may give an indication as to why a new newspaper notice is needed

    The letter your architect got 2-3 weeks ago from the council was i assume the request for further information. the reason I would image a new newspaper notice (and site notice) is required, is because the application is technically changing due to the fact you are no longer proposing to construct a new entrance, but use the existing one. the request for a new newspaper and site notice is a case of the council ensuring that all the boxes are ticked in terms of the paper trail on their side.

    As archtech said, they're just ticking all the boxes. It's a regular enough occurence although the newspaper notice will mention 'significant further information' received.

    I'd just go with it and put the notice back in the paper..
    We got Further info request because our sightline coming onto the road was not the required length.. After taking some rows off the tops of stone walls and cutting trees, this was considered to "significantly alter" the application so new notices in papers were required.
    Our case seems more trivial than the position of entrance so it's a case of just keeping the council happy I think.

    From the date we submitted the further info until the date the decision was made was just over 2 weeks... I think they have a month but in most cases I think they make the decision sooner than that.. probably depends on the county though..

    Yeah, you will have a decision within 28 days.

    In Offaly I understand that they have 4 weeks to get back to you after requesting further information, just waiting on this myself at the mo, fingers crossed. And toes.

    Its a statutory 4 week period so that applies to every Planning Authority.

    Spoke to the architect. He just submitted a basic plan for the entrance. The county council want a plan showing landscapring and proper stone pillars for the entrance though so that is what has held it up.

    The council say it takes 4 weeks as ye say above. Hopefully it'll be alright. I've asked the architect to get it back into them asap.

    Just another thing on this. Can people now object to the planning again? No-one objected first time round but is there a new period available for them to object now?

    yes,
    if significant further information is submitted which the Planning Authority requires to be advertised, submissions may be made during the period of two weeks from the publication of the advertisement. Persons making these submissions may also make an appeal to the bord.

    therefore persons have a new 2 week period to make submissions.....

    it should all be written in the newspaper notice....

    Out of interest what should the wording of the newspaper advert be?

    From the 2001 regs:
    (c) require the applicant to publish a notice in an
    approved newspaper, containing as a heading the
    name of the planning authority, marked “Further
    Information” or “Revised Plans”, as appropriate,
    and stating -
    (i) the name of the applicant,
    (ii) the location, townland or postal address of the
    land or structure to which the application relates
    (as may be appropriate),
    (iii) the reference number of the application on the
    register,
    (iv) that significant further information or revised
    plans, as appropriate, in relation to the
    application has or have been furnished to the
    planning authority, and is or are available for
    inspection or purchase at a fee not exceeding
    the reasonable cost of making a copy, at the
    offices of the authority during office hours, and
    (v) a submission or observation in relation to the
    further information or revised plans may be
    made in writing to the planning authority on
    payment of the prescribed fee.

    You're welcome.

    Your agent should be in a position to do this for you or at least give you the wording. Have a look through the local newspapers of online applications and you will probably spot one.
