Traffic accident

    Hi people any help here would be appreciated. My girlfriend was knocked down two weeks ago she has an independent witness that seen it and backs her up, but the guy driving has his two friends as witness, but can he use these guys as witness if they were in the car with him or does it have to be an independent witness? Also the garda did not take a breath test for drink which i thought was mandatory in a road traffic accident?
