What do you do with an Appearance Letter?

    Sorry don't know if this is the correct forum. I'm not looking for legal advice just a point in the right direction or to the correct forum.

    I received an appearance letter today by registered post. It for money owed on a credit card but given I've lost my job and was getting paid a pittance before that anyway so I can't pay up.

    I have no solicitor and I don't have the money to pay for one so maybe someone can direct me here. Thanks

    It means you intend to fight the case, this is the required form http://www.courts.ie/rules.nsf/0f9632235a96242e80256d2b0045bb5c/8f76a818e8c4aa5d80256f24005ff038?OpenDocument

    You bring it to your local Circuit Court. After that you have 10 days to file a defence.

    You need to consult a MABs office or citizens advice bureau. They can negotiate an instalment agreement, even say 20 euro a month. When you get back on your feet later you can pay it off.

    If you get a judgment against you it will haunt you for a long time.

    PS That's an awful big credit card bill (since it is circuit court). Who gave you a credit card with that limit if you earn nothing. Maybe a complaint to the Financial ombudsman would be a good idea too, he could wipe the debt!!!

    I used to earn a good wage but have had trouble over the last year and a half. This coincided with me having run the bill up, I've run it up and paid it off over the years a number of times.

    What I'm concerned about is that I already offered the bank €50 per month but they were not interested (and believe me I couldn't even afford the €50). They insisted on going down the legal route as they wanted €200-€300 per month. I feel totally lost, I've never owed money to anyone before.

    If you can't afford €50 a month, there is no way in hell they will get 200 in court. Contact MABS.

    Well I know you can't get blood from a stone but I don't want to be dragged through the courts either.

    Get in contact with MABs or a Free Legal Advice centre. Google FLAC

    If you let it run the legal fees will be added on top for getting judgment against you (say another 2000).

    Don't let that happen, get advice and do it today.
