Ebay/Paypal claim questions.

    Hi,

    real small potatoes here. I bought a CD on ebay for £1 (plus £3 pp). When it arrived the items case was broken along the hinge meaning it's effectively useless as an item to put on my shelf etc. I knew the item was 2nd-hand but it was specifically advertised it "as new" which I think contradicts the item condition and that's why I took exception to the situation.

    I contacted the seller and the best he felt like offering me was to refund the price+PP but NOT the return postage which means I would lose out finanically to the sum of whatever the return postage came to (say another £3 for the sake of arguement) so I've refused to return the item under those terms as I'll be left with (a) no item (b) a loss of eg £3 and (c) a lot of wasted time for nothing.

    I escalated it to a paypal dispute and he just responded by saying "return the item , get proof of postage etc". Now HE has escalated the dispute to CLAIM status (which I don't understand in itself because he has nothing to claim considering he sold me a broken item)?

    So who is in the wrong here? Do I stand a chance in this situation? Thanks.

    You will win but have to pay recorded delivery to send back the item. Just take the loss imo.

    Ok thanks. Surely tho if I 'win' wouldn't he have to pay for the recorded delivery? :confused: I mean to have to send back the item recorded would be worse than the situation I already have.

    No. Paypal will not make the seller pay for return postage, even on a broken item, you must pay it. If you don't send it back registered, and the seller claims it never arrived, Paypal will not refund you, as you won't be able to prove it was received.

    Just drop it, and move on. In future, if you get something that's broken, was cheap, and not sent by registered post, just say it didn't arrive, and get your refund.

    Ok thanks. I guess I'll just have to learn from it this time and chalk it up to experience.

    However what can I do now wrt to the claim? Do I even have the choice to drop the issue now or do I have to return the item now regardless of the fact I have nothing to gain at this point? What happens if I don't return it now (esp considering he escalated it to claim status, not I)? He already has my money that I paid so they could hardly take anything else off me? :confused:

    This happens more often that you'd think. As a seller, it is best to have post registered but the cost puts buyers off. Then if the CD is sent in the normal post, it may get damaged and the seller will claim that you should have registered it.

    Best thing is to look around for blank CD cases reduced in Argos etc. and then happy days. Buy the cheap CDs on ebay and replace the case if needs be. You can still claim and the seller may surprise you!

    I cancelled the claim and gave the guy a neutral feedback recommending people don't use him. I think in future if I get something broken like this (esp a cheap item) I'll just do like jorel said and claim it never arrived as imho the fella owed me but there was no way to resolve the situation financially in my favour after confirming reciept of item.

    Thanks to all who contributed. This ebay game sure throws up a few lessons!
