Planning Conditions - 1 Storey Restriction?

    I recently obtained OPP but the restriction states that the building can only be 1 storey (I had applied for 1.5 storey). Has anyone ever managed to overcome this when applying for FPP or should I appeal the condition? The plan is to build beside 2 houses (next door is a bungalow and besides that is a 1.5 storey dormer bungalow). But I am lower down than both these houses so I thought that 1.5 would be fine. Anyone have any experience of this condition? Thanks.

    Speak to the planner. A well thought out scheme may improve your chances, but you need to discuss it with the Planner. Sometimes OPP can do more damage than good.

    First of all you wont get far with an application for permission consequent if you submit a plan that differs from that which has been conditioned on the outline PP. To go for a 1.5 storey house now will entail a straight application for full pp.

    as advised above have a talk with the planner or get your agent to do this. Perhaps you could consider a bit of representation from your local cllr. or TD.

    The main thrust of your argument to the planner will be to show good cause for allowing a 1.5 storey. A good start would be if you can show similar type houses in the immediate vicinity or at least in close proximity and thereby establish that a precedent has been set for this type of development.

    Also, refer to ridge heights (elevation above sea level) of your proposed house and existing houses on both sides.
    Try to have the lower section towards the bungalow and the higher towards the 1.5

    Thanks for the replies. There are a couple of storey and half dwellings nearby and I didn't think it would be a problem as there is a precedent. I am going to draw up house plans and meet with the planner to discuss and show how the proposed building would look before going for FPP.
