Constitution and Law

    Hello,

I'm not a regular poster on boards but i do follow some of the threads. However I recently noticed something which I feel is very serious. Their was a thread posted recently which was discussing a constitution. Their were over 20 comments and relevent questions posted. However a site administrator, Tom Young removed this thread deeming it as 'nonsense'.

The thread was posing the question of the importance of the constitution and how it applied to the man.

First of all I feel this is an abuse of his role and perhaps the power has gone to his head. who is this man to deem a discussion about the constitution 'nonsense' - his opinion is one thing but to actually Close to Thread is another.

My own research leads me without a doubt that this discussion is of vital importance!

Does the constitution apply to the Men and Wome of Ireland or the Government Officials? Don't you see They are bound to it...but we are not. Go one step further with this and ask how can anything the Government legislate apply to the Men and Women of the country without their consent? Enforcing statutory or 'Government by-laws' without the consent of the Man is force.

This country was founded on a Republic which means the rights of the Individual are supreme - If I do not agree with a statute surely I am free to not consent...If I have not harmed another than the Law has no issue with me.
If you disagree with this statement I ask would you advocate the use of force against me for acting freely?

    Statutes/Legislation:-
All Statutory Legislation is based on Contracts and are also referred to as ‘Acts’. You might be interested to note the definition of an Act according to Black’s Law Dictionary:
‘act in the law. An Act that is intended to create, transfer, or extinguish a right and that is effective in law for that purpose; the exercise of a legal power.’
An ‘act of the law.’ is described as ‘The creation, extinction, or transfer of a right by the operation of the law itself, without any consent on the part of the persons involved.

    Common Law:-
Common Law can be very easily understood by the tenet ‘do unto others as you would have them do unto you’. In basic terms: The Rights of one Man end where another’s begins. Common law includes crimes such as bodily harm, theft, assault, cause of loss or injury and murder. This is why you see murder referred to as ‘Un-Lawful Killing’ and not ‘Illegal Killing’.

    Brehon Law:-
Brehon Law is the ancient and True Law of Ireland. It has been around for as long as we have and dates back thousands of years. Brehon Law is one of the world’s oldest systems of Law next to the ancient Vedic Laws of India. Brehon Law existed up and until the 1700’s when it was stamped out by a foreign intruder and the heavily oppressive Penal Laws they introduced. When Ireland gained her Independence, for some reason we decided to keep the British Legal and Financial systems which are still in force today.
During the Brehon Law system there was No Police Force, No Capital Punishment and No Judicial System as we know it today. These were ‘unnecessary’ institutions to the Peaceful inhabitants of the Land. Brehon Law is the Law of Man and is in many ways superior to Common Law. Common Law is in actuality a foreign jurisdiction and you have a Right to claim Brehon Law!

This is the tip of the iceberg friends and the rabbit hole is very deep. We must all gain a stronger understanding of the legal system, our Rights and how to Claim them.

Lets see how long this thread lasts eh Tom?

    In Peace, Honour and Respect

Oh dear god...this recession has really left people with too much time on their hands.
"You have a right to claim Brehon Law!" - ARE YOU FOR REAL? For arguments' sake, If you were to commit an arrestable offense and at trial claim your brehon rights....the judge/jury will have you in Dundrum faster than you can say "tom young...I wish you closed my thread".
Like I said in the previous thread, the people of this republic elected a government with the knowledge that the Free State Constitution of 1922 needed to be replaced and that De Valera intended to do this as soon as he came to power. If you have ever voted in local or general elections you have given your consent to politicians, also peoples of this republic, to draft, debate and pass/sign/consent to legislation on all of our behalves. Furthermore, If you've ever read the constitution, you would know that before legislation becomes law, it must be signed by our democratically elected President on behalf of the public! So YES we do consent to legislation. If you've never voted and are questioning the legal system in this country then f*** off to Turkey.
Also, the reason the first thread was shut down by tom young is because he is a barrister (afaik) and a lot of other people posting here would be legal professtionals, law students, trainee solicitors who have spent long hours studying, interpreting, debating and advocating what is contained in the Constitution and for someone to come along and pose questions and make statements like the ones above is insulting and laughable and really takes up unnecessary space on the forum.

Are you for real? - So what you're saying is if the Government say we have to do something ... we have no choice in the matter - Does this sound like a free country? Are you serious?!? DO YOU KNOW THE DIFFERENCE BETWEEN A DEMOCRATIC AND A REPUBLIC?!?

I'll tell ya what Dante - Brehon Law IS IRELANDS LAW - Wether you like it or not ... if you don't like that and you want these Statutes **** Off to Britain! - It's there Legal system....so go on over there then....you'll love it.

Plus your assuming that I would give the judge authority to hear me in the first place...If I havn't harmed anyone I will not grant him the jurisdiction....and yes it does work this way and I have witnessed a case being dismissed with my own two eyes because he didn't enter jurisdiction.

Can you not see what you have said basically 'you've no right to live freely here in Ireland unless you're doing what we say - so **** off to another country' -

    nice...

    Oh dear....
I really have better things to do (like study constitutional law for the FE1s ;)) then reply to this nonsense.
Do yourself a favour mate and get a loan of Kelly's "The Irish Constitution" and have a read through it.

  • Closed Accounts Posts: 15 eyeswideopen111

And another thing...If the Judge threw me in Dundrum for claiming a Birth Right, nay a God Given Right...He would then in fact be breaking the law.

Wake up to what you're saying...your comment could only be from someone who is completely incompetnent in makeing their own decisions and leave it up to the state to decide whats best for them. Like a baby. Think for yourself, independently like a man and you might be able to find some more productive words to use today...?

Tom Young a barrister? that makes sense cos only someone who's ego's been inflated to that of a pompous barrister would think their opinion is more important than everyone elses and close a thread....makes perfect sense dont you think.

    Thanks for your interest Dante

    Peace and love bro....

You do yourself a favour smartarse and get a copy of Micheal O Cheiruil's version - the original text literally translated.

"I really have better things to do (like study constitutional law for the FE1s ;)) then reply to this nonsense" = you're a ponce who thinks he knows more than he does, and thinks they're more important than they are ... keep lapping up what they're telling you in school there chump.

Erm...were you planning on raising any intelligent points which could be discussed? Or is this all over your head?

This isn't a legal discussion, this is ill informed rubbish.
I'll tell ya what Dante - Brehon Law IS IRELANDS LAW - Wether you like it or not

So, even though the majority of citizens in the country, since the foundation of the republic, are happy with the system of law we have (or else someone would have had a mandate to change it by now), you reckon that Brehon Law is the true law? Who's being undemocratic now???

Intelligent points? I think after reading your comments, anyone with an ounce of intelligence will move swiftly away from this thread. Dont know what im still doing here to be honest.
You dont know me or any of the mods so dont make any direct assumptions about me or them. If you're going to run an idiotic thread, at least keep it civil.;)

Are you completely thick or something? take a look at what that says? "Foundation of the Republic...." then you go on to say 'Undemocratic'

No im directly asking you... DO YOU KNOW THE DIFFERENCE...IF YOU DID YOU COULD SEE HOW COMPLETLEY MISINFORMED THAT COMMENT IS!!!

I cannot beleive it....you think you know a thing or two? Ill informed rubbish you said it mate...you havn't a f*cking clue

Do you know the difference? Do you know the difference? Do you know the difference????

If you have to go off to search and find out the difference...you will know that YOU ARE THE ONE WHO IS MISINFORMED. If you already know the difference...why not re-word that statement....?

I live in the Republic of Ireland....thank you.

Now ... Deal with that friend....instead of making a brash statement try backing it up with knowledge.

I'm awaiting your response to clear up this apparent confusion on your part.

Still waiting for the knowledge from you there Dante?

If 100 people say something is a so...even if it is not...does that make it so?

Truth is Truth hate it or Love it....

The true structure of Authority is

    1.God
    created
    2.Man & Woman
    created
    3.Government
    created
    4.Statutes
    apply to
    5.Persons

If you class yourself as lower than Government, that's fine. Me ... im second only to God...

Where do you want to be?

A little humility goes a hell of a long way...be carefull not to allow your own intellect block flows of information.

In a Republic ... I have a Right to be undemocratic if I want...so long as I do not harm someone?

What you are suggesting is - Demos Ocracy - Or Mob Rule...meaning if 51% of the pop want something - it is forced on the other 49% wether they want it or not....sound fair? No its whoever has the biggest Gang wins.

Now...have you found out what a Republic is yet?

You used the words with an air of authority .... so? Did you know what they meant before you typed it? feeling sheepish? baaaah Run along with the sheep mob baaah....dont think for yourself baaah it's always been this way baaah....everyone knows that baaah

    So is this one.

This is a forum for discussing legal issues. Ireland is not governed by Brehon Laws.

If you wish to start a discussion about how the Brehon laws influenced our current legal system, you are free to do so.

    But be civil please.

Can I ask eyeswide open what his definition of "law" is if normative rules that govern society with sanctions for disobedience, such as the constitution and statutes enacted under it, don't fit within his definition.

I am glad to see one or is it two other the other forum moderators decided to close this thread and not the OP who seems to pointedly have a problem with my moderating.

    Oh well.
