Excess usage charge by O2

I am an O2 Clear 18 month broadband customer. I have a 10gb cap. Last month I exceeded my 10gb cap and was billed €80.46 including my regular €20 charge for the month. I received no notification from O2 that I had exceeded my limit. They just took €80 out of my bank account by direct debit without warning.

The reason I exceeded my cap was probably my own stupidity. I downloaded a torrent and didn't stop it uploading when I had downloaded it. Anyone could have done it! It had uploaded 12.9gb before I realized what was happening. This occurred between the end of the last billing month and the start of this one. This meant all this month's cap and more was used as well. Before I realized what had happened my usage for this month was 12.98 gb. Now O2 are going to charge me another €50.45 on top of monthly charge this month when I have hardly used the internet except for my torrent mistake.

I now still can't use my O2 modem. O2 are charging me €110 for my 'extra' usage over 2 months. I didn't use any more than a few extra gb's but O2 are charging me extortionate amounts for a service it cost them much much less to provide. To add insult to injury when I raised this issue on their own forum I was ignored. Now I don't know what to do. Do I have to pay this mob?

yes. Though if you argue politely and it's a 1st time they might reduce it a bit.

This is an example of why I claim Mobile is being mis-sold. This is what you agreed.

Title modified, as O2 are not robbing you, they're also not a mob. The charges for excess usage are high, but then it does cost the operator a hell of a lot of money to transfer data over their network, when compared to voice or text services. The 10GB you get for 20 euro a month is actually too cheap, so the charges for excess are high in order to offset this, as well as to cover the cost to them for that excess and to encourage you not to do it.

As you said yourself, it was your own stupidity that caused the over use in the first place, so why should O2 have to pay for that?

I'd have to agree, OP you admit to not stopping the download so why should O2 not charge you in-line with the T&C's you have previously read and agreed to.

If you didn't like them and/or read them then you shouldn't have agreed to them and used the service

I know it was stupid of me but I think the price for the stupidity was too high.

Data charges are too expensive in this country. The rates when you go over your cap are too high. I don't think many will disagree.

You agreed to it though and as a result .. sorry man.
