Business name registration - international...

    Setting up a business in Ireland that will provide products over the internet to buy - do i need to register this business name on some international business name registration organisation?

    Also - if selling products that someone say in the States may buy do I still just pay tax on that here there's nothing I need to do as far as International sales?

    Once the name is registered in Ireland and the business is based in ireland there is no requirement to register anywhere else. Also in general Irish vat rates apply to all orders delivered in Ireland / eu.

    exceptions are someone in another eu country with a valid vat number wanting delivery to themselves - this is mainly business to business selling.

    DO NOT respond to any letter asking you to list in a eu name directory / internet registry or anything similar - these are scams.

    If you are based in Ireland, and most of your goods/services are sold to Irish customers, then you have to be registered for tax and VAT(if threshold exceeded) in Ireland. If you require a business name, you can obtain it from CRO in Dublin. As far as your EU sales, there is no complications, but concerning sales outside EU, that might be a little bit trickier. Especially if you sell to US, you might have to report to their Revenue to some extent.You would be better off consulting yourself with an accountant/local enterprise board or even Irish Revenue if you plan to deal mostly with customers from outside EU.

    If you have what you consider to be (might be) a valuable brand name you should consider registering it with the US Trade Mark Office www.uspto.gov and the EU equivalent http://oami.europa.eu/ows/rw/pages/index.en.do* (OHIM) in Alicante.

    You might also want to register the brand name internet URLs in markets where you do (plan to do) business (eg mybrandname.de, mybrandname.fr, mybrandname.com, mybrandname.eu (the latter being a joke).

    There is no legal requirement to do this - but if you don't, you may find others using your brand name/business name, and have little legal recourse against them.

    *Typical bureaucratic, un-user-friendly EU address - the idea of www.trademark.eu or similar seems to be totally beyond the thought processes of these idiots!

    You will be subject to tax in this country, if you are selling b2b within the EU (but outside of Ireland) to businesses who are registered for VAT then these transactions are intra-EU and you do not need to add VAT, equally you should not pay VAT when purchasing.

    With regard to a domain name for your website, you should use an internationally recognised TLD for your main address such as .com, (a .ie domain would not be the best for use in International sales but you should register the .ie domain for the domestic market and to protect your brand - and it would be a good idea to register all the other well known TLD or ccTLD if they are available such as .net .co.uk etc)
