Unpaid Time in lieu

    Lost my job in March of 2008.

    At that time i was owed for hundreds of hours of time off in Lieu.

    Firstly... Can i claim for this time off in Lieu that i never got paid for?

    Secondly... Am i too late in doing so now... considering it was March 2008?

    Any help appreciated.

    I'm not a solicitor, but the first thing that came into my mind is... do you have an e-mail or any sort of document which shows you are owed the time off in lieu?

    I have the orignal email with terms of acceptance when i took up the job. Which stated that I work 40 hours per week and anything above that could be taken as time in lieu.

    Just found out today that the company while still trading, is trading under a different company name since beginning of this year.

    Would I still have a claim against the old company ?

    That only proves that you were entitled to time in lieu if you worked additional hours and not that you had worked any additional hours for which you were owed that time.

    I've got no idea of the legalities involved, but given how late this is I don't think you'd get very far with any claim. Even at the time you would probably have found it awkward to prove that that you were owed such a large amount of time in lieu. If you still want to pursue this any further you're very much in the solicitor territory and I wouldn't be surprised if they told you that it's not worth the risk at this stage.
