    No 'alleged failure' , it was anti competitive gouging of the highest order where eircom tried to evade giving access by hiding behind technical standards . The same pedantic sh1te as the Nutley lane exchange decision a few months back . 80 pages FFS :(

    eircom has had significant market power in small leased lines and segments or PPCs for well over 4 years but Comreg never bothered to remind them of that at the outset.

    This farce has been going on for nearly two years , eircom will simply have to stop offering the product in October if they have not sorted out the wholesale version of it and no fines are proosed for 2 years of interim misbehaviour :(

    Well actually they were supposed to provide to Colt (?) on foot of their dispute last Wednesday. Apparently SDH Ethernet is only on offer to new entrant wholesalers (so no fibre like is supposed to be available to eircom retail) and also if you do a simple google search eircom retail have a 1 Gig Ether offering. I heard a whisper that they openly stated this in a meeting last week? Some industry meeting held in ComReg.

    Also, there time lines to resolve disputes should be litigated and if appropriate an order of mandamus or declaratory relief sought to resolve and make them adhere to their own timelines. There is nothing extraordinary or excusing in relation to market discrimination under these circumstances, yet you get bet an important part of your anatomy that this is what ComReg would rely on as a Defence.
