Motoring fine

    Hi all,

Sorry if this is the wrong place to post.

But anyway, could anyone tell me if there is a maximum of time for a fine to be sent out?

I was stopped over 2 weeks ago - and told I'd be getting a fine. No problems there...lesson learned.

But the thing is that I'll be leaving the country for 4 weeks next Wednesday, and I haven't gotten anything in the post yet.

I know that you have to pay your fine within 28 days. So basically, I'm worried that it might arrive a couple of days after I leave and go unpaid until I get back.

What would happen in this case? Will I be alright if I can prove I was out of the country? Also, is there a cut off point when it has to be sent out to me by. 3 weeks seems a bit long.

    Thanks,

    Dan

The fine should arrive in the post very shortly. Will there be no one in your house while you are away that could pay the fine for you? If there is no one maybe you could ask a friend to check your post for you and pay it when it does arrive.

The process for paying a fine is as follows:

You are given 28 days to pay the fine. If you dont pay it within the first 28 days, you are given another 28 days but the fine goes up by 50%. If the fine is paid within the 56 day period the penalty points (if there is any)will remain the same. Obviously if the fine is not paid then a summons is issued where the fine and points can be higher.

So if no fixed chage notice is recieved in 56 days from the date of the offence does that mean your off the hook? Say a mispelt addres causes the notice to be undelivered. what then?

No....the Garda may issue the FCPS up to the day the offence is 56 days away from being statued barred after the 6 month period. In simpler words you must have 56 clear days in order to pay the fine so you could get it up to 4 months from offence

Thanks for the replies everyone. Sorry I'm a little confused. Is the 56 days the time I have to pay the ticket (plus 50% after the first 28 days)
    AND
the max amount of time the Garda has to issue the fine?

    Thanks again.

If you don't get the fine you can't pay the fine. This has happened in many cases that for whatever reason parties have not recieved Fixed Penalty notices, but later recieve a summons.

If they can say on oath they never recieved the fine, the Judge will either let them off completely, or let them off with the amount they should have been fined on the fixed penalty notice.
I can't understand why the fixed penalty notices are not posted by recorded delivery.

Simple really. Normal letter cost 55 cent. Registered letter costs €5.25 odd + admin.
