Dangerous fence and party wall

    Hi all,

    I'm doing some building work and need some advice on the following.

    Between my house and my neighbours house theres an unsafe party wall (not fixed to the houses). He also nailed wooden panels to the party wooden fence and there are rusty nails and screws sticking out my side. I've approached him about this and offered to have my builder remove the party wall and rebuild it safely, and also temporarily remove the dangerous panels and replace them securely. All at no cost to him.

    He is having none of it. I am unsure about how to proceed next. Should I speak to the council or my solicitor?

    Council not involved unless either
    1. either house is a council owned house
    2. the wall is in breach of planning permission.

    talk to your solicitor

    It is a wall or a fence? If it's a fence just build your own block wall on your side and be done with your neighbour. By your description he doesn't sound anyway reasonable. I don't think you need planning permission if you keep it under 1.8m or 2m high, but check with your council.
