PAYE surcharge appeal

    Hi Guys,
    Just wondering if anyone has any experience in this:

    I just filled out a late PAYE tax return for 2006. I didn't realise I had to fill one out but it turns out I had to as I had become a shareholder/director of my brothers company, even though it never made a penny. Turns out though without filling out the forms, I was losing my PAYE credits.

    So I filled out the form and turns out I was entitled to 1337.62, however they have fined me 885.63 of that for a late return. I never made a penny outside my PAYE earnings and have always paid my tax. Being charged €885 for not filing out a form seems a bit excessive.

    It's says on the letter I can appeal the charges, but do I have any grounds for an appeal?

    I have successfully appealed a number of these cases. The Revenue have the authority to waive the surcharge if they want. You should do the following:

    Ring up the income tax department of your local paye district. You'll find it on www.revenue.ie

    When you get through to an individual tell they you'll like to appeal the surcharge. They'll tell you that only the inspector can authorise a waiver or a surcharge and you'll have to send your appeal in writing.

    Get the person's name and fax number adn send them a fax appealing the surcharge on the following grounds:

    You have a good compliance record
    It was a once off error
    There was no loss of revenue to the exchequer
    You've put procedures in place to make sure you are complient in the future

    Then ring the original person you skoke with every week to get an update.

    That should get it waived.
