I recently got a phonecall from 3 asking did I want to upgrade my modem which i accepted. I got a letter in the next few days saying I was now on a new contract for 12 months. I was not told about this contract nor did I sign any new contract. I called them to cancel it but they said thats not how they do things and that…

If I didn't sign a contract with them to renew it is it still valid?

If they have a recording of you accepting it, yes. If not, you can ask them to prove you have a contract, and they won't be able to.
