Do I have a criminal record?

    Hi all,

    I'm form Derry (nordie lol)

    A good pile of years back (1999) I was caught in a night club in Donegal (the Grill) with half an Ecstasy tablet.

    I owned up to it... didn't give the Guards any problems and got bailed out of the station that night.

    I went to court on my court date in Leterkenny.
    My solicitor didn't show up... thankfully I found another solicitor on the steps of the court house to represent me.
    He asked who the guards were that arrested me... I pointed them out.
    He went over and spoke to them for five minutes... and came back and said that he would represent me.

    He said we could use the probation act (i think thats what it was called).

    Basicaly... I pleated guilty and I paid 800punts to charity.
    My solicitor told me that I wouldn't have a criminal record and that would be it all over.

    But is it really?

    I've got a new job in Belfast and they're doing security and background checks... and if I have a criminal record I could lose the job.

    Will this show up... or is it really all gone?

    PS: I've an Irish Passport and I've been in the states loads of time since then and I know they look for drug related records... so I'm figuring if I had a record like that... then I wouldn't have got in to the country?

    I find it hard to believe you were prosecuted for possession of a half of one pill, I really do not to mention claiming you paid 800 pounds to the poor box.


    Anyway if the probation act was applied you do not have any criminal record, it's a second chance so to speak.

    I know... 800 notes for half an E...
    During the time they were clamping down on drugs big time... and the fact that I had brought them over the border and that I was from the north made it even worse.
    I think they were making an example of me :(

    But what can I do... as they say... I had to take my oil.

    Before I was caught I had already taken 1 1/2... therefore I only had a half left.

    Therefore I brought *Them* over the border.

    For defs it was 1/2 I was caught with... I know it hard to believe but why should I lie?:rolleyes:

    If you got the probation act, you won't have a criminal record. I'm not sure why McCrack's being so cynical about this because it really doesn't matter whether you're lying about the quantity or not. Once you got the benefit of the probation act, you probably don't have a criminal record. It just means that if there's a next time, you will get one.

    I'm not being cynical, I'm being realistic and sussing out the BS but yeh youre right it doesnt have any bearing on the OP original Q so it's a moot point I guess
