Can I park my car in my own estate?!

    Firstly, I'm not sure what I'm about to type constitutes a request for legal advice. If so, that's not what I'm after, more a pointer in the right direction.

    Am living in an estate and the road is overcrowded with cars, so to alleviate congestion I park mine around the corner at the top of the road. it's not obstructing anyone, there are no yellow lines and no 'no parking' signs or anything forbidding parking. if anything, i would think it helps, keeping another car off a very congested and quite narrow road outside my house.

    Anyway, I've been told that there is a chance legal action will be taken/ is being pursued by residents to prevent me from parking my car where it is parked and that I might even receive a summons.:mad: This could well be scaremongering, but was hoping someone might be able to point me in the direction of any laws or legislation which govern this area, so that i might find out whether I have a leg to stand on or not?:confused:

    Who has control of the estate - the council or a private company?

    If is the council and there is no prohibition (note the catch-all dangerosu driving, which includes dangersou parking), then the council and garda won't be interested.

    Got a driveway? :)

    Heh, yep, have a driveway but it's full with other cars!:D Not all houses do though, leading to a lot of cars being parked outside. Thus, I would've thought doing everyone a favour by not creating more haoc/congestion.

    Pretty sure it'd be council owned, the estate is around since the 70's and I don't even think a private contractor built it back then. I would have thought it was a ridiculous threat?

    Be careful that you are not parking within 5 metres of a road junction or opposite a continuous white line. Sometimes people think they are parking legally when they are not because of these two issues.
    If you are on a public road and not parking illegally then there is no question of your being issued with a summons. The main danger would be damage to the car by irate locals.
    If your driveway is being blocked then an offence is being committed. That should be reported to the guards.

    Thanks Jo. Car is not parked at a continuous white line, as there are none in the estate. It is parked between two T-junctions in the estate, but the gap between the two is huge (2 houses + front + back gardens) and in no way is it anywhere near five metres to either of them.

    TBH, I don't think much will come of it and it's just neighbours with nothing better to do, but given the length of time I'm living here and the fact we've known each other for years (they'd be of an older vintage!), I think it's quite petty and I want to be sure I have a leg to stand on if something comes of it.

    All advice much appreciated and any more welcomed.
