hi, could I ask a question.

A friend of mine has just been let go from their job, it was through a petty misconduct - the company are not paying redundancy and are literally taking any opportunity.

He was working 3 days a week, was reduced down from full time about 4 months ago and has been claiming job seekers allowance for the other 2 other days.

his partner has a good full time job, about 30k a year, they recieve the standard childcare benefits from social welfare.

he has been payin PRSI since starting work and has never claimed until the 3 day week came into effect.

what is the best course of action ?
will he loose the jobseekers allowance ?
does he have to wait > the socialwelfare.ie website said you have to wait 9 weeks before anything is paid ?>

as said his wife is working, however they have 2 kids, mortgage, car loan, 2 bank loans.they had finally started getting things just this doesnt help!

Your friend will need to bring his P45 to their local SW office & advise them of their change in circumstances.

The decision regarding the 9 week penalty wait will be made by the deciding officer. They are usually sympathic, but I'd advise your friend just to be honest from the outset about why he was let go, everyone makes mistakes. There's a good chance that they won't impose it, but it is a judgement call on their behalf which he can appeal if it comes down to it.

As it could be embarrassing or awkward for him in a crowded office depending on it's layout he can ask to be interviewed in a private office or booth, so as there won't be any danger of others overhearing.

It's not 9 weeks - it's up to 9 weeks.

Disqualification from Jobseeker's Allowance

You may be disqualified from getting Jobseeker's Allowance for 9 weeks if you:
• Left work voluntarily and without just cause
• Lost your job through misconduct
• Refused an offer of suitable alternative employment or suitable training.

That's a typo - here another part of the website:
Disqualifications and Disallowances
Section 147(4) of the Social Welfare Consolidation Act, 2005 provides that a person may be disqualified from receipt of JA for up to 9 weeks where s/he has lost employment through his/her own misconduct. The duration of the disqualification is discretionary, although it may not exceed 9 weeks.
