Temporary Redundancy

    Hi there,

    Just looking for advice..........if an employer puts someone on temporary redundancy, can the employee then ask for redundancy immediately?

    There is no such thing as 'temporary redundancy'. But in fairness to you, I presume what you are talking about is a temporary 'lay off' situation. There is statutory provision permitting an employer to temporarily lay off employees because of lack of work, but an employee does have a right to request to be made redundant if that lay off lasts longer than 4 consequtive weeks or for 6 weeks in a 13 week period; and if then the employer cannot then offer you 13 weeks unbroken work within 4 weeks of seeking to be made redundant, you are entitled to a redundancy payment. On a practical note though, this is a reasonably technical area and there is a definite onus on the employee to be proactive because the employer is under no automatic obligations unless the employee requests their entitlements.
