Lease question

    Hi, I have registered with the PRTB. I have a tenant, only moved in a few weeks ago. She wanted to move in earlier than agreed so I let her. but this meant that I did not have the lease ready. I am preparing it now and will be sending in on to her today to review and sign. I will also be giving her a copy of the lease agreement once she has it signed.

    However, when I mentioned the lease the last time I saw her last saturday, I got the impression that she is not keen on signing one. She did not say anything, it was just more the way she looked at me and she did not say much.

    What happens if she refuses to sign the lease? Its for a fixed term of 1 year. I am not happy to have her living there without the lease agreement signed. If she refuses, can I give her notice to move out? Or what are my options? Thanks. And I know, lesson learned, I will not let anyone move in without the lease signed next time.

    as she is there under 6 months you can provide 28 days notice of termination of the tennancy is she refuses to sign the lease.

    Absolutely you can. It would be very hard for her to challenge since she both refused to sign the lease and is there under 6 months.

    That said, there may be simply something on it she's not happy about.

    Personally I have not renewed leases for the last year as my job situation is insecure and I do not wish to tie myself into a lease I may not be able to afford the rent on.
