The legal diary on courts.ie

    Just wondering, very quick question really. Say if someone had a pending court appearance and it was listed on courts.ie, but in the end the hearing never happened as it was sorted out beforehand, but the listing still remains on courts.ie eventhough it was a few months back. Should this not be deleted from the site?. It was called on the day but the persons solicitor attended for them to advise along with the dpp that the case had been dropped.

    On the main page - go to High Court Search. Accept the terms and conditions - Enter in the Parties, Court and or Reference Number and hit return. A list of cases or names should appear.

    It's the listing section on the Left hand side to see what happened to a case.

    Hindsight a couple of things might have happened:

    1. It wasn't struck out;

    2. A settlement might be awaiting ruling; or

    3. The otherside are pressing it on.

    It would not be deleted from the website because of a settlement. Even if a matter is settled between the parties the court must make some order in relation to it. Sometimes to rule the settlement or strike it out. The order is part of the administration of justice which means it must be done in public.

    It was settled in January and supposed to be struck out on that day, but it was not actually struck out until a few weeks ago. The person involved only had to go to court once last Jan and then solicitor appeared the last time to have it struck out and the dpp agreed.
    It's still listed on the legal diary for both dates (months ago now though) with a case number. It's over now and people have got on with their lives but certain people don't seem to want to let it go or leave them alone and think having this information is power over them.
    If it wasn't still on courts.ie, well it would be fine.

    Courts.ie leaves everything on which passes through the courts. Even if a matter is struck out or does not proceed a record is kept. It is a useful facility for allowing people to check on the history of particular cases. There is an issue of privacy when it is used by individuals to cause embarassment. It is possible that the courts service would delete a particular record if they were asked.

    It's actually been used by certain inlaw family members to make up lies and have a great gossip session. It's a total abuse of things and now a solicitor is involved having to write to them individually to say this case is now closed. This shouldn't really have to be done as why should someone have to proove anything to them. They are just evil really. One of them said they spoke to some Garda "friend" who gave them info on it, which is all untrue, but when I asked for the Gards name they wouldn't give it to me so I can complain to the Garda Ombudsman.
    Nobody knew a thing about it until they saw it and have told the whole country at this stage, even using a social networking site to blab it. Very stressful when the person they are doing it in is about to have a baby anyday now!.
    It was minor thing and the accusation was false but it took a while to proove and settle in the end.
