Short Time Versus Reduced Hours (Redundancy)

    Short time is less than half the working week and reduced hours is a 3 to 4 day week. Redundancy is looming (possible today), I'm 50, no mortgage or serious bills so if offered I'd be inclined to take it. But if they put me on reduced hours is my redundancy based on the 3 -4 day week when finally calculated. I read (below) that with short time statutory redundancy is based on the full week.

    Is this correct?

    "Redundancy payment when on short time If you have been put on short time and then are made redundant your redundancy payment may be based on your pay for a full week. It has been the view of the Employment Appeals Tribunal that when a person is put on short time, that is, less than half their normal weekly earnings, the gross wage for the calculation of a redundancy lump sum is based on a full week's pay".

    As far as I am aware, your redundancy is calculated on the hours you worked per year, so for all the years you worked as a full time employee, you will get the full amount (about €600 per year I think now?), for the reduced hours, I think its a case of if you spend more than half the year at the reduced rate(part-time) then only this period is calculated at the reduced rate....but maybe give citizens advice a shout to be sure.

    If you've been on short time for less than a year then your full week would be used for redundancy calculation. If you've been on short time for over a year then the calculation will depend on how willingly you went on short time. If it can be shown that you willingly went on short time and didn't make a reasonable effort to get back to full hours then the redundancy payment would be based on the short time. Otherwise it should be based on the full week.

    If there is a problem the EAT (linked above) should be able to adjudicate.

    Thanks guys,

    just back from the meeting and I think I've escaped - FOR NOW. However, there will be reductions in staff. Reduced hours was mentioned for me but the HR/Admin guy was not sure about entitlements to benefit if we reduced our week by 1 day so he's going to look up the details. I think it has to be 3 days out of 6 before I could apply for benefit. Vol. redundancy was not on the table.
