Gender Discrimination in work

    Hi,

    I know I cannot get free legal advice here, but I am after an opinion...

    I have been working for a company for 3.5 years in varying roles. For the past 15 months I have been working along side 2 male workers in similar roles.

    I say similar, but I have been the team leader of said sales team - although this role was given to me with no extra pay (I chose to take it for advancement in the company)

    Anyway, it turns out that the 2 male members of the team have been earning 5k a year more than me - even though I have the more senior role apparantley.

    Anyway, as soon as I realised this, I asked for a pay rise to be brought at least level with the 2 males.

    I was adwarded this increase today (they could hardly say no) however i feel it should be backdated.

    The 2 males are no more qualified than I am - in fact I am the best person on the team in terms of revenue generated.

    Am I wrong to ask for this to be backdated?

    I feel it should - opinions?!

    It appears that your employer may have a different salary negotiated for each member of staff. The fact that the others were male is probably irrelevant and co-incidental. They may have discussed a better package. I very much doubt that it could be deemed to be gender based discrimination.

    Incidently, to agree to do extra work for no extra pay probably won't help you in the long run as you may be seen as a 'soft touch'. It also makes it difficult for anyone coming after you who may rightfully expect to be properly remunerated.

    Thanks Wishbone - in regards to the "extra work" I will not be doing that again and have advised them of same.

    But surely 3 people doing the same job (or me doing more) should be paid the same? I have asked in the past for pay increases and have been advised they weren't possible - yet they pay the other 2 more money?!

    I work in a techinal environment which is traditionally male orientated.

    However do you think I am correct in asking for my pay increase to be backdated?

    Once you have been in a job for a period some/most companies cap there level of increment available to internal movers - e.g., 10% cap. Whereas if a person was hired from the job market the likelihood is that the candidate may join for up to 30/40% more than an internal candidate.

    I don't think that you can attach this to gender discrimination at all, I'd be more inclined to ask whether the other candidates were internal or external? In any case, and with respect, 5K is a small amount in relation to an average middle to senior executive. It equates to about 100 Euro per week before tax.
