It isn't. A lot of races are on open roads.

There are very few races run on closed roads. It's legal and normal practice to run them on open roads, albeit with marshals and lead cars etc.

Indeed, most races are on open roads. Really only the pro events and some crits have closed roads AFAIK.

Does permission need to be obtained from the Gardai first? To hold any race.

Yes for an open race a safety report has to be given in at least a month in advance. For league races we have to give the Gardai a list of dates, courses, ambulance cover and a minimun number of marshals as well as a chief marshal.
They are usually very good but have refused permission on occassion if they feel the route is unsafe or not well enough marshalled. Previous experience with the promoting clubs is also a factor.
We've never had a serious problem. A few years ago there were complaints about riders crossing the white line by a motorist. The Gards were happy with how we dealt with it.

Just out of interest, how was it dealt with?

Bloody white van drivers! Hope the guy's OK.

Off topic but only the Gardai have the right to stop traffic on open roads, race marshalls dont. I'm always consious of this when stopping cars while marshalling, always wave and thank the cars for stopping once the cyclists pass. Only once got some fat eejit in a car shake his head in exasperated fustration at being stopped. Generally 99% of cars are great and surprisingly friendly.

I'm not sure of the legislation but a friend of mine failed his driving test for not stopping for someone holding a piece of paper with "Stop" written on it. I think there were road works going on.

Maybe that's just considered "good practice" or whatever though...

When I've marshalled, I've been told that marshals have no authority to stop traffic. So you're there in a warning/advisory capacity and if someone doesn't want to stop there's nothing you can do.

All members were given a standardised letter at the start of the next race warning them that it was unacceptable and dangerous. It was also posted on the website and for the rest of that season each group was warned when starting.
It was a valid complaint BTW

no surprise to me that the vehical in question was a van. not 1 month ago a van pulled in in front of me without inidcating and i crashed into it. thankfully i had managed to break some what but left the scene yelling profanities at the driver. the problem is they cant see squat let alone a cyclist
