Upstairs downstairs ownership.

    Hi all,
    This might sound confusing, but please bear with me.

    In the family there is derelict house/site.
    The house was a two story town house, long before my time, but the upper story was knocked for safety reasons.
    On the ground floor there is a garage, which the upstairs was built over.
    This garage is belonging to a different person.
    Over 20 years ago my family demolished our ground floor, to enlarge our adjacent properties. It is still unbuilt upon though. the shell of the garage remains though.
    The family that own this garage have shown no interest in it, but repeated offers to purchase it from them have been refused.
    The property now has gone to the next generation, and I have heard that the new owner has aspiarations of developing a two story apartment here.
    She will never have known the house as it once was, and the deeds are not specific of the upstairs overlap.
    How can I proove that she only has entitlement to a one storey build?
