Tv Licence Question

    Hi,
    I've been living in my place together with 2 more flatmates for the last 3 years and we have never paid for a TV license. Yesteday an inspector came and my flat mate opened the door for him. The flatmate was asked to confirm his name and was asked if we have a TV license, or a TV set connected and stuff like that and he refused to answer the questions and invited the inspector to see for himself if there is a TV in the apartment or not. The inspector did not wish to inspect the place and just said that if we have a TV said we need to buy a license. The thing is that we actually have a TV set in place, which we never use, so we are thinking of getting rid of it. My question is "Is it too late (did my flatmate confirm that we have a TV set by denying to answer questions), or they need to inspect the place again before they can take us into court to pay the licence?

    He already did it, so I'm wondering if they would accept his silence as a sign for "yes we have a TV set". Not that the inspector did not wish to inspect the premises for a TV set.

    Have you ever heard the terms "presumption of innocence" and "right to silence" ?
