    Hi All,

    Perhaps you could help me with a very stressful situation:

    I own an apartment which I can no longer afford to live in, as such I am living with my mother again :( I have the apartment on the market but there is a problem. The neighbors upstairs have two huge dogs which bark loudly whenever anyone coming to view walks in the communal door, this immediately puts them off. The apartment in question is I believe being rented out to the local council who house people in need of housing there. I don’t know the name of the owner. Ive been on to the management company about this for the last two months nearly daily but they keep telling me ‘the owner has assured us the dogs are gone’ they tell me they are going to ring back but never do. They tell me to get solicitors letters but alas I can’t afford to do this. It is in the management company’s contract that no dogs are allowed in the apartments.

    My questions are:

    · Do I have a legal right to know who owns the apartment? (Id like to contact them directly as im not sure the management company are even doing this)

    · Is it not the management company’s duty to sort this out?

    · Any other advice would be greatly appreciated.

    Ps. I love dogs and have no problem with them myself, its just the fact that im trying to sell and there putting all my potential buyers off!!

    No, but you can always send them a letter or call around

    It is, if it is a term of their lease not to keep dogs. However many management companies are less then responsive to tenants needs.
    · Any other advice would be greatly appreciated.
    If the softly softly approach doesn't work with the neighbors, you can complain to the district court under the control of dogs act 1996. Your local district court office should have the relevant form.

    You can also complain to the PRTB under section 15 of the PRTB act if its a residential tenancy governed by that act.
