Charges for fighting?

    Just curious, if someone was caught fighting by the gardai but not detained.
    Should that person expect a summons if the gardai took their name and address?
    And if so what sort of charge would he/she receive?

    just a guess but I would think that unless you were taken to a station - you werent officially charged with anything.

    I think they just took your details to check up on you and mark it in your file - if you have a history of similar offences and/or other offences or any warrants for your arrest then you may face possible prosecution. (public order offences maybe)

    depends on alot of things, if someone made an official complaint with statement it could be assault
    the gardai may charge drunk and disorderly or a similar charge
    or in alot of cases the gardai on duty might decide its not serious enough to follow up.

    not expert advice by any means, just guessing from what has happened to people I know

    How bad was the fight?
    was anybody injured??

    it was 2 friends who had an argument and it came to blows.
    Dont think either have any previous convictions.
    No one was hurt but a few punches were thrown.
    One of the guys is worried incase he gets a summons. He thinks his mum will kill him!:D
