    HI ALL I BOUGHT A CAR IN THE MIDDLE OF APRIL IT HAD ONLY TAX VALID TILL THE END OF APRIL,THE TAX BOOK WAS SENT AWAY WITH CHANGE OF OWNERSHIP AND I ONLY RECIEVED IT LAST WEEK ,ITS NOW THE END OF MAY WILL I HAVE TO BACK TAX IT FOR MAY OR WHAT DO I DO

    to the tax office with you! and yes you'll have to back date it to the day it became your property.

    If the car was used or kept in a public place during May you will have to pay the tax from 1st May.

    Of course not. Boards or it's users would never encourange someone to be dishonest with the Gardai or the tax office.

    Yes, this is perfectly fine, Get the form stamped by the Guard (on June 1st or later) and tax the Car from the first of June not May.

    The only reason for back-taxing it is if you are actually caught for having no tax. Regardless if you drove itor not it is perfectly acceptable to get it stamped and declared off the road for the month of May.

    That's pretty poor advice. maybe it's something that's regularly done, but it's not "perfectly acceptable".

    This is something that is done by 99.9% of people. It is perfectly acceptable yes, Why pay tax for a month that is practically over? Tax to a Government who make the Sicilian Mafia look like a reputable organisation! Everybody does it and I can't see any problem with it. I would see more of a problem if the fella said "oh, blast it, I won't bother paying altogether".

    Because the form witnessed by Gardai is a statutory declaration and it is a criminal offence to make a false or misleading declaration punishable by a fine and/or imprisonment.

    As Colm says, it's commonly done, but not acceptable or legal.

    If you feel comfortable following this course of action, go for it, but I'd say it's unfair to advise someone else "sure, it's grand" when by following your advice they expose themselves to legal penalties...

    My log book (or whatever they call it these days) for my new used car is on its way. Well, according to the Vehicle Transaction Enquiry it is anyway. Can I just print out that RF100A form and post it off with a cheque, or is there some other form I should be using? Revenue, motor tax and county council websites all seem to be concentrating on what to do with an import :rolleyes:

    As for suggesting people declare a car off the road when it wasn't, wouldn't it be a tad embarrassing if a speeding fine turned up later for the period when the car was supposed to be off the road? I suspect the gardaí might frown on that sort of thing.

    That form is fine just be sure to fill in everything required. If you are taxing a Commercial Vehicle for the first time in Co. Kerry you must get a Good Declaration form filled in and stamped by a Guard or else do it yourself at the tax office. This practice varies from county to county and in Cork this is not needed, but then again this is only for a Commercial Vehicle van etc.

    If the car is private then the form is perfect and if you are taxing the car from June 1st you will need the guard to stamp and sign the form, if taxing it continuing on from the old tax in a second hand car then there is no need.

    Eg. Tax expired the end of april by previous owner you can tax it from first of May without a declaration, to tax it from June 1st requires the Guard to declare the car off the road for May.

    Hmm, that might be an issue - the tax was expired on the car when I bought it, and I've no idea when it expired.

    If you were using the car, pay the tax like the rest of us have to.
    I know of a case where A guy went to the gardai to sign the form and they did. A week later, the same garda happened to be doing some paper work and noticed that he had stopped same car with other family member driving during the period where it was supposed to be off the road. I forget the details now but they were in court.
    As someone said, what if you get a speeding fine in the post? The judg would throw the book at ya and all for the sake of a few Euro

    Nah, I'll play it straight, even though it was only on the road a couple of times. Didn't know about having it signed off before May though. Given that I've no idea where it was in April (or when the tax ran out), am I at fault if it *had* been on the road before I bought it?

    You're not liable for tax while you didn't own it.

    If you PM me your reg, I can tell you when your tax expired (if you want).

    Whenever it was though, it doesn't matter, the main thing is when you started using it on public roads.
