Lease Finished - Potential conflict

    There are 5 of us sharing a house.

    - Lease is up at start of June
    - We have asked for a reduction in the rent last week if we were to continue the lease, however the landlord could not meet our demands so we have found a house nearby that does.
    - Landlord is now saying that we should have given him 1 month's notice regarding not renewing the lease.

    Are we now not entitled to our deposit back?

    Was it written into the lease that you had to give one months notice?

    A simple expiration of the term of occupancy specified in the lease, does not infer the lack of existance of a lease- and if you are not in keeping with the terms of the lease (re: notification etc), then you are obliged to adhere to the notification periods specified in Part 5 of the 2004 Residential Tenancies Act.

    If you have been there a year- the notice period is 35 calendar days.

    Details of Notice Periods:

    28 days Less than 6 months

    35 days 6 months or more but less than 1 year

    42 days 1 year or more but less than 2 years

    56 days 2 years or more but less than 3 years

    84 days 3 years or more but less than 4 years

    112 days 4 or more years

    You are fully entitled to pay rent in lieu of notice, should you so wish (with the concurrence of the landlord).
