Insurance question

    Hi

    Had a crash, reckon its the other parties fault. Got an estimate for the damage way over the top! Just wondering if i win the claim will i get a cheque or will the garage bill the insurance company directly?

    You reckon the other person was at fault?
    What happened?

    They'd more than likely send a cheque to the garage directly

    Before the issue of fault is decided the other driver's insurance company should send an assessor out to view your car and the estimate prepared.

    Based on this they will confirm the quantum (value of the claim)

    then IF (a big if) they confirm liability (fault) is with their client then they will make you an offer based on the agreed quantum.

    What you do with the money is your own business.

    What happened is that i was driving in the right hand lane, the other party was driving in the left hand lane he swerved to avoid a parked van in his way and pulled straight across me. It turns out that we are both with the same insurance company. They already sent out an assessor im still waiting to here back as to who is at fault!

    Sounds like it is 100% the other drivers fault.

    From what you say the damage should all be to the drivers side of his car and to the passenger side of yours.

    Not that you will need them for sure but do you know of any independent witnesses?

    this is a no brainer?

    the other driver should have stopped behind said stopped vehicle.

    thats what i would think anyway

    unfortunately it was a truck that i hit as you can see from the damage to my car the only thin that might go against me is that there is no marking in the middle of the road to say that there are 2 lanes but as you can see from the other picture there clearly is 2 lanes!

    A truck you say? that is actually in your favor. Courts place a higher degree of responsibility on truck drivers then they place on other road users, Judges have a particular dislike for them and they always find it much more difficult to successfully defend cases and yours and his Insurance company will be aware of that.

    The fact remains that the trick moved his position in road from the left hand side to the middle/right hand side to avoid an obstacle.

    Once the truck began that movement responsibility was all on the truck driver to make sure it was safe to move over and there were no other road users, he clearly didn't do that and is at fault. As legs11 said he should have behind the parked van.
