Reinstating struck-off company with the CRO? Help

    My company was struck off the companies register for not filing its first annual return. (We didn't file a return because we hadn't started trading.) I know I can reinstate it by filing a H1R form, but that the CRO require all the pending returns to be up to date before they accept the H1R. So, if I submit the return, do I still have to pay the late filing fee, given that it's for a struck-off company and it's the first return?

    Just wondering if you got notification that you needed to file returns? or that you where going to be struck off?
    I don't want the same to happen to me!

    I would be extremely surprised if you did not have to pay the fines. At least the fines stop accruing after 333 days.

    Yes, fines still have to be paid, but be sure to reinstate within 12 months of the strike off date, otherwise you have to get a high court order to have the company re-instated. All o/s returns & filing fee's still apply.

    Regarding the fines, you can write to them setting out why you did not file returns and they _may_ waive the fine.

    Only reason they will waive fines is (1) death of director or immediate family member (2) serious illness - with accompanying doctors cert

    Hi

    Just check to make sure that your company is "struck off" and not "strike off listed". A company can be on the strike off list for up to two months before it is actually struck off. You usually get a notice from the cro well in advance to the company's registered office. But if this address is different from your home address you wont have got it.

    In any case you will have to pay all late filing fees up to date. The returns will just be sent back to you otherwise.

    Next years accounts will also have to be audited.
