Can NightClub be Liable

    i was recently assaulted in a nightclub by two individuals . The CCTV clearly shows they were the aggressors and as a result i've lost two teeth and had to get 10 stitches. Along with that the hearing on my right side has been affected.

    I've spoken to gardai and they are unable to identify culprits. i was wondering do the club hold any responsiblity for this assault and what action can i take.

    if it happened inside the nightclub you should have an avenue for liability dude.

    sorry to hear bout the damage cause. i can relate as i was recently assulted myself outside a club by 4 scumbags and lost all the nerves for my front teeth. i was very angry for a while after but what can you do only move on.

    sorry about that mate - the only advantage i have is that it was in the nightclub. i ended up in hospital and managed to retain the ticket for my jacket. when i rang them they said they didnt have my jacket and theirs nothing they can do

    unreal i pay for a ticket so they should defo reimburse that

    they should deffo reimburse you for the jacket - thats shocking behaviour.

    with the cctv why cant the gaurds not identify the blokes concerned ?

    In order to successfully sue the night club, you would have to be able to prove that there was inadequate security on the night in question or that the bouncers did not react in time or at all to the incident. It's not enough to simply say that it happened there so it must be their fault. You/your solicitor should request a copy of the CCTV footage from the nightclub owner at this stage. Chances are if you look for it a few months down the line, they won't have it.

    There is potential to fix the nightclub with liability but that will depend on the particular facts.

    You need to contact a solicitor practising in personal injury for advice. Most will not charge for the initial consultation.
