Notice of termination

    I was given my 2 weeks notice 1st May that I was finishing up on the 15th May (although the boss said there may be more work after this date depending on if certain tasks/jobs were finished)

    Its now the 21st May and im stay working (all be it part time, which I've being doing for the last 2/3 months) And I most probably will be in next week too and even the week after that.

    So my question: Does the boss have to give me another letter with 2/1 weeks notice? I presume the answer is yes?

    So this would be great news as this would take me to 2 years continuous employment, happy days!

    Employer legislation gives "Minimum period of notice" normally 2 weeks which you have been given at this stage. I suppose any further time you work is a bonus ...

    Any redundancy entitlements are based on your termination date not the notice date.

    If you worked less than 2 years then he can give you 1 week notice. Between 2 and 4 years its 2 weeks notice.

    If you are still employed by him after notice is given, then he will have to give you notice again after that to terminate you contract of employment!

    Query: an employee who worked for me for 2 years left and worked elsewhere for a year and returned and has been working for me for 16 months what minimum notice do i have to give him? is it one week? or two?

    AFAIK its 2 years continuos unbroken employment thats required - but I stand to be corrected

    I'd imagine since your employee left and broke their service the new employment starts and they have only worked 16months, so 1 weeks should be enough.

    The notice period in the contract of employment will take precedence over the statutory notice period, as long as the contract doesn't give a shorter notice period.
