I know the title is not great, but just wondering for a friend of mine. He went thru a bad experience with a previous employer 2 years ago and could not proove he didn't do it so was found guilty in court very recently. Now apparantly a certain paper has been contacted by his former boss and it's grossly exagerrated, they even got a photo of him, and the reporter contacted my friend wanting to hear his side of the story. He was in such shock he said he has nothing to say and to leave him alone. The stuff the reportercame out with is shocking, cannot believe someone would say these things and that is would be published.
Is there anyway this can be stopped legally?, he has a young family to protect and recently started a new job and is a good person. He was helpless against what he was accused of.
He has managed to shield everyone from this so far and thought it was all over until now, he just wants to protect his kids from getting a hard time in school over it and his own family being talked about.
Sorry, cannot say anymore about it but from what I can gather he has to let it be and nothing can stop it.

If he was found guilty in a court of law then the press are perfectly entitled to report the story....

The answer to your question in short is..Yes you can stop the press from publishing a story via an injunction..BUT this is very expensive and you must proof a prima facie case and give an undertaking as to costs amongst other things.

Hurting a guys feelings by printing a Court report is not sufficient grounds I am afraid and your friend will have to take it on the chin provided of course it doesnt contain untruths.

Also an accurate report of court proceedings is privileged and can never be stopped.

Also since he was convicted by a criminal court a person is perfectly entitled to say that he committed the offence he was convicted of without risk of defamation.

Thanks for the replies, just talking to him there and he actually has not been found guilty as the case has not even gone that far yet, he entered a plea (was in for arrainment??) and that is what they are going to print about along with whatever your man is saying about him, but it was the ex employer that contacted the paper in question to tell them what day he was in court coz the papers usually are not interested until sentencing happens I think so we are all shocked that there not another court appearance in relation to this for over 6 months and this happens now???.
So, an injuction costs alot of money and it's something nobody has at the moment!
