Business gone bust

    Hi All

    Looking for some help for a friend.

    He was employed by a small family garage for the last seven years.

    The business went bust suddenly two months ago. Turned up for work one day and it was closed. But it is re-opening next month under one of the other brothers names. (he has already asked and they wont be giving him a job)

    Situation is they have no money to give him redundancy. He went to dole office to sign on they told him the company only paid stamps for him the first two years he worked and have not paid any for the last 5 so he is entitled to nothing basically.

    Is there anything he can do? Is the pr*ck that he worked for not accountable for some sort of fraud is he wasnt paying prsi over?

    So no redundancy, no dole. what is a man to do?

    The Revenue Commissioners have enacted a number of laws in recent years to deal with the scourge of 'Phoenix Companies' (as they call them). That is companies who collapse in order to avoid their many obligations (in the Revenue Commissioner's case- payment of tax, including PRSI for your friend). I would query it with the small cases section and see whether they are aware of it. Its a slow process- but you will get your pound of flesh in the end.
