Getting paid for bank holidays

    I have a question about getting paid for bank holidays, even if you don't work on the day it falls.

    I think your entitled to 1/5 of your weekly wage for that day.

    However I have been working a 4 day week for the past 6 months and it just happens that i don't work Mondays.

    I'm on a salary which was deducted approx 20% since my days were reduced.

    Is it still possible to claim for this 1/5 of my weekly pay? I work at least 30hours per week over the other 4days.

    if your on a salary it shouldnt matter to you. As a salary based employee you should earn the same every week.

    However the rules surrounding bank holidays are as follows.

    if you are normally rostered for a Monday for the 6 weeks preceeding a bank holiday then you are entitled to those "normal" rostered hours as your bank holiday pay entitlement.

    Otherwise the qualifications for bank holiday entitlements are that you must work a total of 40 hrs in the previous 5 weeks and then the hours that you worked for the previous 13 weeks are used to average a daily hours at which you will get as an entitlement.

    Your employer choses which form of entitlement you can get as there are other methods such as a paid day off in lieu/extra days holidays.

    you can be paid for working the bank holiday at flat rate so long as you are paid the respective entitlement, however if you employer choses to pay you at a higher rate ie Sunday rate then you are not entitled to any additional entitlement.

    however all that said you are salary based and as such do not recieve calculated bank holiday entitlement as this really on applies to wages workers.

    In your position you are not entitled to anything extra from the bank holiday.

    Sorry but this is incorrect, being salaried don't change the fact of the bank holiday and the 1/5th pay for it. Same way I could be scheduled for 4 days a week full time and I'd still be getting the 1/5th for the bank holiday.

    No he is correct.

    Salary includes everything.
    He got a 20% reduction in pay when he went from 5 to 4 days.
    OP should have pointed out the fact that he was entitled to 1/5 for the bank holidays and got slightly less than a 20% cut. He could try and go back now and get his salary changed based on this fact, but he is not due any extra payment.

    If i earn on salary €50k a year regardless of the hours or days I work(obviously a minimum will be required) etc I still only get €50K before tax obviously.

    After that the only other thing in my favour is bonus time if any.

    The only way to get pad for a bank holiday if you only work 4 days such as your example Nody is to be paid by the hour employee.

    Thanks for the replies guys.

    Just one more point i'd like to make. There are other people in here who have Fridays off, therefore when a bank holiday falls, they get paid their usual salary but have worked a day less etc...

    I know its probably down to me to re-negotiate my current working conditions/contract, but i just thought if i was legally entitled to some payment for the bank holiday it would be easier to ask my boss for it!!!

    no legality but your point can be used as some leverage
