What to do.

    I'm a little short of inspiration with a problem that has surfaced with a friends BER assessment. Because of conflicts etc I declined to do a BER assessment for them on a house they were thinking of placing on the market early this year. They went with a guy in north Dublin who charged them €440. Ill health and a hospital stay for one of them forced them to abandon the house sale and I hadn't seen either of them until the hospital stay was finished last week. I asked for a look at the BER cert but they never received it from the assessor. I took their MPRN number with me and searched the National register but nothing entered against it. I phoned SEI this morning to get them to check it too and still nothing. I will have the assessors details this afternoon and will check him out to see if he is registered but what if he is not? What is my course of action? Any suggestions?

    I think this is a legal issue.
    See what he says, if he wont talk to you, get your mates to talk to him.

    If he withholds from them, solicitor time.

    Seems a little strange that he has not uploaded the report however, I think it is important that your friends, his clients, talk to him first just to see if there has been a misunderstanding. As you know, he should be providing them with both the BER Cert and the Advisory Report. They should also get or have got a receipt from him. If he cannot answer their questions satisfactorily, they should ask for his Assessor Number and advise him that they intend to take it up with the SEI. I suspect that will sort things out fairly quickly.

    I would like to think they/you are a long way from having to down any legal route with the assessor but the ball will be well and truly in his court when they chase him up.

    If they paid in cash, no paper trail, they have no redress.

    If they paid by cheque then engage a solicitor, file a compliant with SEI, fraud squad and CAB { Criminal Assets Bureau }

    silver, did you check yet to se if he was registered??

    there may be a simple explanation here.... contact they guy and find out what the story is...

    It seems that an invoice was issued and they have tried to call him at the number on several occasions - its an estate agency I believe. I hope to have the invoice this evening. I offered to pursue it for them because they have been through quite a lot of turmoil medically in the past few weeks. I will update as it progresses or not. When I get a name I can check the registration then.

    The guy is not registered as an assessor. It seems that he did the survey work then he sent a letter stating that the rating was C2 along with a typed up list of suggested improvements and that he would forward the cert when the SEI sent it to him. I would imagine that he probably did the training course after which he had a copy of the DEAP software - thats if he actually did the data work. Or maybe he failed the FETAC exam, one never knows. Either way, he shouldnt have taken the money.
    I told the client to demand the money back but I doubt if they will have much luck as the guy is obviously a fraudster. Is there any point in sueing for €440?

    Small Claims court is for under €1000, isnt it?

    Where did they get his details?

    most certainly report this guy to SEI...

    as administrators their system is being brought into disrepute by this joker....

    they may wish to bring it further on their own behalf...

    I think it will probably go to small claims if he doesnt hand over the cash.
    sydthebeat, I m waiting until the money is returned or not before I report to the SEI. I'm not all that sure if it will interest them however.

    Report it to SEI as well as starting a claim with the small claims court. SEI have no jurisdiction over this guy but he has been purporting to be an "agent" for SEI which cannot be tolerated.
