UK Vat refund

    Hi folks,

    I'm VAT registered here in Ireland but going through some receipts, I notice that I've been charged VAT on some purchases from the UK.

    I thought I would be able to reclaim this VAT by completing the biritsh VAT65 form, but it says this:
    VAT65 Form wrote:
    I hereby decalre that: a) the goods or services specified in the itemised schedule(s) were used for the followig business activities in the UK:

    This seems to imply that I can only reclaim UK VAT on business activities conducted in the UK (like a business trip, for example).

    Can I reclaim the VAT on purchases from the UK? If so, what form do I use?

    You should have given the UK supplier your Irish VAT number and they would have not charged you UK VAT but rather you would be oblidged to include an input and output credit for Irish VAT on the supply.

    Now that UK VAT has been applied my first port of call would be with the supplier who incorrectly applied UK VAT to get it refunded from them.

    I don't work in VAT so someone who is more knowledgeable than me may be knocking around with first hand experience of the correct steps to have this refunded.

    I'm presuming this is a supply of goods and not services?

    i helped a client a few years ago with a similar problem. there is a piece of UK legislation that allows a UK supplier to credit your account and refund the VAT incurred if you were VAT registered in ROI when the goods were sold and they werent aware of it.

    the VAT65 is the correct form to use. be careful as the form has to be received by UK HMRC by 30 June following the year the VAT was incurred.

    the office handling these refunds is based in Derry and you could contact them for advice.

    this was a few years ago so things might have changed now so id double check everything.

    Somewhat OTB - if you purchase online for delivery to Ireland - for personal use, can you claim vat back? or ask the seller to remove the Vat?

    No.

    Only registered traders can claim VAT back. It's lump it for the rest of us.
