    few questions here and id appreciate some serious answers if possible

    1. if a person is put on 6 weeks notice , can the company then at the end of 6 weeks put you on temporary layoff ?????

    basically a person i know in my job whos working full time for the past 12 years in this job was given 6 weeks notice to then be told at the end of the 6 weeks he was being temporarily lay-ed off and was told to go to the social welfare , and when he asked for redundancy he was told NO , having said that we let around 20 workers go in the last 5 months and all were payed there redundancy and not working here as long as this worker is ??? is this allowed ??? seems like there messing him about and he has 3 kids and a mortgage and they want him to sign on the dole and work for a day here and there ????

    he wants to just leave at this stage with his redundancy , but wants to know that if he tells them he isnt gonna be put on temporary lay-off that he wants to leave , does that effect his claim for redundancy ??

    any advice would be appreciated

    Tell him to contact NERA. If he's been working there on a permanent contract for 12 years, he's entitled to a minimum of 24 weeks redundancy @ €600/week.

    Any chance he is in construction?
    If he is put on temporary lay-off he should have been issued a form RP9. After a period of 13 weeks has passed on this form (during which time he is eligible to claim SW) he then completes a section at the bottom of the form requesting redundancy. The company have to either pay him the redundancy at this time or reinstate him.

    yep construction

    he was only told yesterday he's been put on temporarily layoff

    but he doesnt want this , as he feels he's been dangling on a string for them

    He should get a solicitor and go after his employer for his redundancy money like a spider monkey. he's completely right and entitled to leave they cant withdraw the notice.

    i mean it seems they dont wanna pay out anymore redundancy and yet want to keep him on , when it suits them ???

    they gave redundancy to an ex employee who couldnt work anymore because of health reasons , wasnt their fault but still paid it

    another polish guy who had chose to leave after 4 years was paid , when they didnt have to as he chose to leave

    and this guy whos here 12 years and has a blind wife and 3 kids and mortgage they want to shaft him ???

    im on 3 days a week in this company and if this is how their gonna act i wanna go myself , im here 9 years myself

    I currently work in construction (I am the evil one who fills in the P45's etc) and they are actually within their rights to do this - if there is a lack of wokr or whatever on the sites. The reality is that they probably dont have the money to pay redundancies right now and are trying to buy themselves some time.

    He must have been issued an RP9 form or he will be on his last day. The unique thing about RP9's in the construction industry is that SW payments can be paid from day 1 afaik - there should be no wait.
    Like I said he can apply to claim for redundancy after 6 weeks I believe (I was wrong with the 13 weeks I stated above). The employers can counter-claim that he will be back in employment within 13 weeks so no redundancy will ba paid

    i fill in the P45 here too etc

    i know alot of **** that would put them up ****e creek , ie afairs , end of month bonus's paid in cash and i can prove this

    they fook with me and i will be like super rat

    the cheek of them to act in this way , when they have been using company money to buy apartments to rent or build apartments etc and then say they have no money ?? they swindled every penny out of it

    were not in the building trade as in houses or flats but in an otherway
