Can anyone tell what the legal stand point is on recording telephone conversations?

In a completely hypothetical situation where someone was to record a telephone conversation without a persons knowledge or consent? Hypothetically, would does that person have any grounds for recourse?

I dont think a recorded conversation could be used as evidence against someone unless they were informed that the conversation was being taped. Thats why insurance companies etc tell you the conversation may be recorded.

Generally if one party of a conversation is doing the recording, there isn't a problem. Anyone else and there are likely to be problems.

This question arrives here about once a month, I don't get why users don't search for this issues first.
