HELP NEEDED ASAP ..CAR ACCIDENT

    hey guys
    was makeing a right turn in to a gate way in a 60kph speed limit when a big jeep crashed into the back of me throwing my car 80 +feet foward my car weighed say 1400kg while her jeep weighed 3 ton plus .she was definitaly going more than 60kph and dident even try stop no tire marks on road just about ever bit of glass from my car on the road .....
    the garda were caled all they did was swap insurance details .
    i went to hospital and was admited and kept for 5 days

    how does someone get away that easy like how can u ram up the back of someone and get away scot free
    what do i do now ????????????????????????????
    does anyone have any information on what should i do or any opinions

    Jesus.... Thats rough. No they shouldnt be able to get away with.

    They rear ended you. Your 100% in the right. Go back to the Gardai, your

    insurance company too. Don't let them away with it.

    First of all, I hope you're alright 60kph is a fair speed to be hit at.

    Second, sometimes the gardai prosecute for carless/dangerous driving other times they don't. You could speak to them and ask them are they going to issue a summons. If not, you could consider a private prosecution but it may not be worth it.

    Finally, you can get compensation for the repairs to the car, medical expenses, personal injuries and other expenses from the other person's insurance company. You should probably speak to your solicitor for advice on it because 5 days in hospital would not be a minor injury. Your solicitor can deal with the insurance company and all the forms on your behalf if you like, so you don't need to worry about it too much.

    As the others have said, you need to get this reported to your insurance company and to theirs. Let them know what damages you have to your car, injurys to yourself etc and assuming it's as straight forward as you say it is then they should look after you.

    * These are my personal thoughts, and you won't get advice on legal issues on Boards if that's the avenue you decide to pursue.
