As the title says... Is this new? I thought I had read here before that it wasn't.

It was on mine recently. But it was the free "retest" type fail if fixed within 30 (?) days.

It has been a fail since 2004 at least and probably since the beginning. From the 2004 NCT manual
    ITEM
    Anti-lock Brake System
    REASONS FOR FAILURE
    (4) Warning light not working or indicates a defect in the
    anti-lock system.

The ABS light and the main beam light are currently the only warning lights needed for the NCT. This may change in the next review when airbags lights may also become part of the test.

It is a fail but ive seen a few get through with no problems. It just depends on how strict your tester is really.

I failed for this once , the airbag light was also on but they said nothing about that

Is a car that came with ABS but the ABS is not working more dangerous then a car that never had ABS?

Driver may be expecting the ABS to operate whereas a driver of a car without it may pump the brake pedal to try and avoid the wheels locking.

Or not, but I'd suspect this is the logic for failing on it.
