Legal issues with Pyrotechnics!!!!

    Hello all!

    Here's a strange question for you - in thereoy if someone was to import pyrotechnic material, what legislation and / or licencing laws are in place to regulate this?

    I'd pretty much be interested in knowing what the maximum amount you can buy or bring into the country and what, if any, licence you would require for handling material over a certain limit?

    I don't know if anybody would be familuar with such laws, but I wouldn't even know where to begin to look to find out!!

    I know (or at least am reliably informed) that in the international legislation pyrotechnic materials of up to 3 gr. of explosive material per item are allowed to be used / traded by private individuals.

    Is there any specific guidelines in Irish law that relates to this?

    Its Illegal without a license

    Criminal Justice Act 2006

    Specifically ;
    Section 68

    (2) Any person—

    (a) who possesses a firework with intent to sell or otherwise to supply it to another, and

    (b) who does not hold a licence under this Act to import it, is guilty of an offence.

    (3) In any proceedings for an offence under subsection (2) it is not necessary for the prosecution to negative by evidence the existence of a licence to import the firework concerned, and accordingly the onus of proving the existence of any such licence is on the defendant.

    Penalty :
    (12) A person guilty of an offence under this section (except subsection (10) or (11)) is liable—

    (a) on summary conviction, to a fine not exceeding €2,500 or imprisonment for a term not exceeding 6 months or both, or

    (b) on conviction on indictment, to a fine not exceeding €10,000 or imprisonment for a term not exceeding 5 years or both.
