rear ending someone

    Hi,

    Last night some friends and I were in have a few responseblies and as it happens conversations come and go but this conversation came up and seemed to be the topic of the night. If someone was to rear end you if the person in front suddenly jammed on the breaks for no reason what would be the outsome. The conversation went on and one of my friends was convinced that if some one runs into the back of you no matter what its their fault another said both parties would have to pay for each others damage or vice versa as it was neglegence on both parties behalf, but i disagreed surely you would have to give some reason for jamming on and the person the hit your could counter sew and what not. This went on for a while but i'm unsure as to what would happen and i've asked around and no one seems to know the answer. Any comments would be great to get an answer back to the pool!:confused::confused::confused:

    If you have left a safe distance between you and the vehicle in front then you won't rear end them. That's the law. If someone jams on their breaks and you hit their car it's you that is at fault and your insurance will have to cover damages.

    You're screwed if you rear end someone basically. You have to be driving at a speed that enables you to stop within the distance you see to be clear ahead of you and be keeping a safe distance from the car in front.
    There may be some abnormal circumstances for someone jamming on for no reason to try and get you to rear end them, but it'd be very hard to prove.

    In my mind quite simple

    If your car has front end damage , the other car has rear end damage.... it's your problem . UNLESS they reversed into you of course.

    I actually had a nice case years ago , someone ran into me . He later claimed I changed lane suddenly in front of him ( which I hadn't by the way ). The insurance mans response was , I don't care if he fell out of the sky in front of you , you should be able to stop ..... I won

    Barring extremely extraordinary circumstances,
    If someone rear ends you, they are at fault.

    You should allow enough distance between cars to stop no matter what.

    Is there anyway to prove that someone reversed into/rolled back into you? It happened to me that someone was infront waiting to pull out at a junction, I was behind and they started to roll back so I blew the horn over and over but they kept rolling and hit me. Luckily there was no damage, but if there had, could it be proved that they were at fault?

    You would need witnesses to prove that you were not at fault.

    Even more reason to stay well back!

    Though I saw a scary thing last week in Ashbourne. I was coming onto the N2bypass roundabout at the Marriott from Slane and there were these two modified cars, a white newish clio and an old civic coming from the Bypass behind me but looked to be trying to get ahead of each other onto the roundabout. We stopped at the lights beside Dunnes and I heard shouting and and a lot of banging so I looked in the wing mirror and spotted 2 lads from the clio get out and start kicking and thumping the civic behind me. They were leaving fair dints in the panels. I think if I was sitting in my old civic, I'd have reversed into the new clio :) all joking aside though, I never wished for lights to change as much in all my life!
