Breaking Lease

    Hi all,

    We (4) are giving one months notice to our landlady this weekend.

    Our contract expires in August, we are leaving due to high rent, and some issues over her refusal to issue receipts or provide her PPS number.

    Is this ok legally for us (early termination with notice)?

    Can she withold our deposit?

    You are legally entitled to receipts for payment of rent.

    You are not legally entitled to break the lease, however, unless the PRTB says you are. It will likely take them far longer than August to decide on that matter, however.

    Is there a break clause in your lease? If not, I believe you have to request permission to assign the lease and then if said permission is refused, you can leave without penalty.

    It is always worth calling Threshold for queries of this nature by the way.
