Woman gets access to dead lover's sperm

A Bronx judge has given a woman permission to get the sperm of her deceased lover so she could attempt to conceive his baby. The fiance, Johnny Quintana, died at 31 of an apparent heart attack.

Quintana had wanted to have a second child with his fiancee. Doctors say his sperm had to be collected quickly because it only stays viable 36 hours after death. A court order was needed to harvest the sperm, because Quintana and his fiancee, Gisela Marrero, were not married. The judge gave permission Friday with only four hours left until the deadline.

Sperm bank staffers went to Jacobi Medical Center, where Quintana's body was. His fiancee, Gisela Marrero, already has a 2-year-old son with Quintana.

It already is, "til death us do part". Marriage ends at death as would an informal partnership. Therefore the survivor has "marital rights" vis-a-vis the deceased.
