Have you folks seen this article on ENN:

If Phorm are in breach of EU data privacy regulation, then wouldn't Eircom also be in breach if they were to monitor internet useage as per the IRMA Eircom agreement?

Probably, the EU already told France to feck off for their attempts at 3 strike rules across the EU.

Frances own attempts to introduce it failed too.

That isn't to say the EU doesn't want to support copyright holder protection as it is also looking into that area AFAIK.

There are probably people that know more about this than me, well there definitely are :)

Slightly differing issue. This case is about exemptions and transposition of EU Law. Phorm by its nature is an interesting business model.

If you ask me and some others Ireland is in a fairly similar position vis transposition of the very same directive. Some have complained, nothing was done.
