Appealing for driving license back

    Hi
    Hope someone can help here. My boyfriend is halfway through a drink-driving ban and is now elligable to apply to have his driving license re-instated once he has served two thirds of the ban in a few months time.

    Only thing is we have no idea how to go about this. Would really like to avoid hiring a solicitor because we can't afford it at the moment so was wondering if this is possible, or is there no way around it and you just have to get one.

    Really I'm looking for any pointers on where/who to go to in order to re-apply for license on our own if anyone could help?

    i went thru same few years ago, as far as i remember you just go to the clerks office at the court and they'll tell you what to do, no need to hire a solicitor

    THanks for that, but where is the clerks office at the court?

    Is it that place where you pay your fine, on the quays?

    i was done at the court in dun laoghaire, out there the clerks office was round the back of the building, there'll be a clerks office at whichever courthouse heard the case when he was banned

    Don't forget the original paperwork from when they got the ban, you'll need the case number and relevant dates, etc.

    You don't need a lawyer, but the chances of getting the licence back are obviously higher if you have one. It's not an automatic thing, where you get it just for asking.

    But then again, DIY will save you at least €450!

    it IS an automatic thing, deffo do NOT get a solicitor, you don't need one

    It is not automatic.

    In fairness, in most areas they are given by the court once there is no Garda objection and the initial fine has been paid, but you still have to outline your reasons and the court has a discretion to send you packing with your ban still in place.

    They changed the rules a while back , the automatic thing no longer exists.

    Indeed, so if you have been acting the prick down the town at the weekends and the Gardaí were aware of your drunken antics they will be quick to object and you will be sent on your way with your ban to finish out. Driving is a privilege and not a right.

    Make sure he's handed in the driving licence to the court office as well. As stated before, he won't get it back unless fine is paid and licence handed in.

    It costs €20 and he has to give the Gardai at least 14 days notice of the application.

    Thanks for the pointers. It's been the only ever time he was in trouble and gave in license and paid the fine on time etc so hopefully won't be any hassle getting it back
