Relocation Question

    Hi,

    What rights do employees have if their company issues them with notice of an imminent relocation? (without any voluntary redundancy option might I add)

    Have the company got a right to make it mandatory by way of the initial contract that the employees signed?

    Is there any period of notice entitlements etc?

    How far is the new location from existing place of work? Anything in your existing contract? I know my contract states location can change to anywhere in Dublin.

    Thanks for the response,

    The move is still within the region of Dublin, however we were initially told it would not be until the end of the year, since then I have relocated to the midlands where I'm commuting to work from. Then they reduced the moving time to under two months, which will put me in a position where commuting is not possible... (from the midlands that is)

    And yes, I think there is something in the contract about working at their other premises...

    Well, it's probably not what you want to here - but I think they are within their rights to do this.

    Ok, the time frame is a bit tight for you - but I guess they are trying to cope with the current market situation and are not in a position to extend this further.

    Remember, it's also not their fault that you have chosen to commute from the mid-lands. There is no need for them to offer you redundancy as it sounds like you still have a job in Dublin with them, plus it's in your contract that you may have to work at their other premises.

    There is one thing I forgot to mention -

    In the latter half of 2008 the company I work for was taken over ownership by another company, yet we did not sign or agree to any new contracts. So, is my old contract still legally binding or am I in some sort of corporate limbo at the moment? If it's the latter then there is no employee mandate for the move I assume?

    was your company bought out? if so its still in existance so your existing contract is still valid.

    if the work you do/service you provide was bought out then yes you are entitled to a new contract etc

    there should be no need to offer redundancy as it sounds like your comapny is doing fine so why offer it at a cost to the company.

    again depends on the wording of your contract. might you be in a position to ask for a period of time before the move say a week or two? they might jsut do it as a gesture of goodwill
