Rear ended by non insured car. Help!

    Hello,

    I was looking around to see if there was any information on my enquiry.

    I will try to explain the best I can. I need to know what to do now/next. Any help would be appreciated.

    I was stopped on a main road awaiting for traffic to pass so that I could turn right when all of a sudden I was rear ended. This car had NO tax (out in 2007) NO nct (out in 2007) and had displayed an insurance cert til 01 - 10. The following day my insurance company informed me that the other parties insurance was cancelled a month before the accident.

    My vehicle has been looked at by a qualified machanic (friend) and he says that it would cost alot to fix the damage caused so they might right off the vehicle as it would not pass the nct.

    I went to A&E and got pain killers as I had pain in my back. After the 7 day cource has ran out my back and neck are so sore I cant even hug my son without being in pain.

    I honestly do not know what to do or where to go from here. If i claim for my vehicle can I claim for personal injuries as they are seen to, I'm totally lost as this is my first accident and to top it all off they weren't insured.

    Anyone have any ideas please let me know.

    normally its the person who crashes into the back of someone who is in the wrong. You be grand. I suppose ya have whiplash.

    If you have comprehensive insurance, you should be able to claim off that and they'll handle chasing up the uninsured drivers for costs and you won't lose your NCB.

    All well and good in principle, but you will find your NCB suspended whilst they fap around dealing with the claim and in the end they may not bother claiming from the MIBI leaving you with a damaged NCB.

    In this situation you are best to get a solicitor to sue the MIBI direct.

    contact the Personal Injuries Assesment Board in relation to your whiplash injury. The book of Quantum on the website will give you an idea what sort of compensation you would be likely to get if your claim is upheld. The PIAB will then take up the case with the Motor Insurance Bureau of Ireland and an Insurance company will then be assigned your case to compensate you. (This usually takes a bit longer than normal)

    You could contact the Motor Insurance bureau also to see where you should go from here. If you want to sue for personal injury you dont have to get a Solicitor as the PIAB will look after this for you as your injury is not serious.

    If you need to get your car back on the road as soon as then if you had fully comp insurance you can claim your own to recover the damage to the car but you will have your no claims suspended in the meantime. The people best placed to help you deal with this and advise you would be your own insurance company.

    Hopefully the Asshole who did this to you will loose their licence. Best of luck im sure it will all work out in the end.....

    thanks to all for your advice. I am patiently waiting for tomorrow to arrive so that i can get the ball rolling. I's scared of driving my Jeep incase I have another accident or it falls apart.

    I only bought my (second hand) jeep 3 months ago :( so Im a bit peed off at the fact that it now could be written off and the money that the insurance gives me back might not be enough to replace it with another one (as you all know they only give back 3/4 of what you insured it for)

    I will keep you all informed. It's just a pity that people like me are left on the long arm and that we suffer because of idiots that dont BOTHER to get there papers in order :(
